The trial court ruled the threshold count of eight must exclude any employee who does not actually perform work on the pertinent date. We reverse, and hold the key inquiry is whether an individual has an employment relationship with the employer on the date in question. We adopt the "payroll method" of counting with respect to both full-time and part-time employees.
